Terms of Use
Please read these Terms of Use carefully before using Butter. By ticking the consent checkbox and using the tool, you agree to be bound by these terms. If you do not agree, please do not use Butter.
1. About Butter
Butter is a clinical document summarisation tool operated by Butter Health, designed exclusively for use by qualified clinical and educational professionals in the United Kingdom.
Butter uses artificial intelligence to read uploaded background documents and produce structured narrative summaries. It is a productivity aid — it does not provide clinical advice, diagnosis, or treatment recommendations.
2. Who may use Butter
Butter is intended for qualified professionals only, including occupational therapists, educational psychologists, dyslexia assessors, speech and language therapists, paediatricians, SENCOs, clinical psychologists, and other registered or accredited clinical and educational professionals.
By using Butter, you confirm that you are a qualified professional acting within the scope of your professional role, and that you have the authority to handle the documents you are uploading. Butter must not be used by members of the public.
3. Your responsibilities as a user
3a. Documents and data
You are responsible for ensuring that you have the legal right to upload any documents you submit to Butter — that you are acting within your professional role, your organisation's data handling policies, and have an appropriate legal basis under UK GDPR to share the personal data contained in those documents with a third-party processing tool.
Under UK GDPR, you are the data controller for the documents you upload. Butter Health acts as a data processor on your instruction. The responsibility for the lawful sharing of that data rests with you.
3b. Reviewing output
Butter Health accepts no liability for errors, omissions, or inaccuracies in AI-generated summaries.
3c. Professional standards
You agree to use Butter in a manner consistent with your professional obligations, your regulator's standards, and your organisation's policies.
4. What Butter is not
Butter is not a clinical decision-making tool and does not provide diagnoses, clinical recommendations, or professional advice of any kind.
Butter is not a secure records management system and is not designed to store, archive, or manage patient records.
Butter is not a substitute for reading source documents. Summaries may miss nuance or context that is clinically relevant. You remain responsible for the source material.
Butter is not approved or endorsed by any regulatory body, professional association, or NHS organisation. Use of Butter is at your own professional discretion.
5. Acceptable use
You agree not to upload documents you do not have the legal right to share, use Butter for any purpose other than generating clinical summaries in your professional capacity, attempt to reverse-engineer or copy the Butter tool, share your account access with others, or use Butter in any way that violates applicable law including UK GDPR and the Data Protection Act 2018.
We reserve the right to suspend or terminate access for any user who breaches these terms.
6. Data processing and privacy
Your use of Butter is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
In summary: documents you upload are processed to generate a summary and are immediately discarded. Nothing is stored. Your documents are never used to train AI models.
7. Intellectual property
The Butter tool, its design, and its underlying systems are the intellectual property of Butter Health. You may not copy, reproduce, or distribute any part of the tool without our written permission.
The summaries generated by Butter from your documents belong to you. We make no claim over output generated on your behalf.
8. Disclaimers and limitation of liability
Butter is provided "as is". We make no warranties — express or implied — regarding its accuracy, completeness, or fitness for any particular purpose.
To the fullest extent permitted by law, Butter Health shall not be liable for any errors or inaccuracies in AI-generated summaries, any clinical or professional consequence arising from your use of Butter's output, any loss arising from your failure to comply with your own professional or data protection obligations, or any interruption or unavailability of the service.
Nothing in these terms limits our liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded by law.
9. Subscription and payment
Access to Butter is provided on a subscription basis. Current pricing is displayed at butterhealth.app. Subscriptions are billed monthly and can be cancelled at any time.
We reserve the right to change our pricing with reasonable notice. We will notify subscribers by email before any price change takes effect.
10. Changes to these terms
We may update these Terms of Use from time to time. We will update the "last updated" date at the top when we do. If changes are material, we will notify users by email. Continued use of Butter after any changes constitutes your acceptance of the updated terms.
11. Governing law
These Terms of Use are governed by the laws of England and Wales. Any disputes arising from your use of Butter shall be subject to the exclusive jurisdiction of the courts of England and Wales.
